Following the news that the trademark is abandoned:
The Last Guardian's trademark in the US has been abandoned, but it appears this was due to an administrative error at PlayStation America, as Sony has confirmed to GameSpot that the project is still in development.
The most recent news surrounding The Last Guardian was revealed in December last year, when Ueda said in an interview that the game was moving forward under "completely new conditions."
It's possible Ueda was referring to the game transitioning from PlayStation 3 to PlayStation 4. The Last Guardian was initially announced back in 2009 as a PS3 title, though Sony has dodged questions about platforms ever since.

UPDATE 3 FEB 17 09:58: SCEE has confirmed to
VideoGamer.com that The Last Guardian is still in development, but has yet to comment on the reason for the trademark's cancellation.

I’ve always found things like trademark or domain name registration to be poor indicators of which games are or are not being made, so it comes to no surprise that after a rumor that Sony was purposefully abandoning The Last Guardian trademark, that they’ve come forward today to emphatically state the game still exists, and is far from dead.
The story was circulating yesterday that Sony was letting go of the expiring trademark for The Last Guardian in the US, which many took as a sign that the game had gone full vaporware, and would never see the light of day. Since then, Sony has confirmed to multiple outlets that yes, Team TISI -0.64% Ico is still hard at work on The Last Guardian, and the trademark issue was an error. The lawyer in charge of filing the renewal notice is no longer with the company.
