January 2, 2007 - Right before Christmas, mobile maker In-Fusio dropped a big lump of coal in Microsoft's stocking: A lawsuit. In-Fusio is suing Microsoft over the $2 million deal that licensed the white hot Xbox game series Halo to the mobile publisher. Late last year, In-Fusio released the first Halo product, a portal where subscribers could download ring tones, wallpapers, and other customization goodies.

But behind the scenes, says a story from the Seattle Post-Intelligencer, all was not well. According to In-Fusio, "In-Fusio's Halo programming designs are subject to Microsoft's approval, which cannot be unreasonably withheld." In-Fusio believes Microsoft was unfairly not approving In-Fusio's game concepts. Non-payment is not the issue according to In-Fusio. The firm had made good on its first $500,000 payment to Microsoft in early 2006 and had reached an agreement to delay the second payment, due June 2006, as no concepts were yet approved.

"In the last 11 months, Microsoft has approved no fully-developed In-Fusio Halo game designs; ignoring and then refusing to accept In-Fusio's game design concepts with little or no explanation and leaving In-Fusio little basis to revise its concepts to obtain Microsoft's approval," reads In-Fusio's official statement regarding the suit.

During the time, In-Fusio has been spending development money on Halo properties. The suit cites multiple submissions to Microsoft, including two concepts that were delivered in June 2006. Microsoft denied each concept, and according to the suit, In-Fusio was provided with "no good faith basis" for the rejection. More submissions were delivered in July 2006, and Microsoft waited until August to deny the concepts. According to the suit, In-Fusio believes Microsoft was continuing to not provide "sufficient written guidance to allow In-Fusio to produce an acceptable design." Following this set of rejections, Microsoft requested the second $500,000 payment. After another set of rejected submissions, Microsoft declared that that In-Fusio was in breach.

Finally, Microsoft issued a termination notice to In-Fusio on December 27, 2006. As it stands now, Microsoft has not issued a formal response and In-Fusio wants to discover whether "Microsoft wrongfully withheld approval of In-Fusio's Halo game concepts."

IGN Wireless will have more on this story as it develops. However, it sounds like the mobile Halo games -- like the Halo movie -- is on definite hiatus.
